Terms of Service

These Terms govern your use of Studio, a client portal operated by Thomas Hart ("Studio," "we," "our") at studio.thomas-hart.com. By creating an account you agree to these Terms. If you don't agree, don't use the service.
1. What Studio is
Studio is a workspace for clients of Thomas Hart to manage website projects: capturing the brief, uploading assets, approving designs and staging builds, and making payments for project work. It is not a generally-available SaaS product; access is granted per-engagement.
2. Accounts
You sign in with Google or via a one-time email link. You're responsible for keeping your sign-in method secure. Tell us immediately if your account is accessed by someone else.
We may suspend or terminate your account if you misuse the service, violate these Terms, or if your engagement with Thomas Hart ends. You can also delete your account at any time via Settings.
3. Payments
Project payments (deposits and final invoices) are processed by Stripe. By paying you agree to Stripe's terms and privacy policy. Studio does not store full card numbers or bank account credentials.
Refunds are handled at Thomas Hart's discretion based on the underlying project agreement (proposal, statement of work, or signed contract). Once a project is delivered, payments are non-refundable unless your contract says otherwise.
4. Your content
You own everything you upload (briefs, photos, logos, copy, brand references). By uploading you grant Thomas Hart a license to use that content for the purpose of delivering your project — design, development, hosting, and the agreed deliverables. You confirm you have the rights to share whatever you upload.
Don't upload anything illegal, malicious, or that infringes someone else's rights.
5. Deliverables
Ownership of project deliverables (the final website, design files, etc.) is governed by your underlying project agreement with Thomas Hart, not by Studio. If you and Thomas haven't signed a separate agreement on this, the default is: you own the final deliverables after payment; Thomas Hart retains rights to portfolio use unless you say otherwise in writing.
6. Availability + changes
Studio is provided "as is". We try to keep it running, but we don't guarantee uptime. We may update or change Studio at any time. We'll give you notice of material changes to these Terms by email or in-app.
7. Liability
To the extent permitted by law, Thomas Hart's total liability for any claim related to Studio is capped at the amounts you've paid us in the 12 months before the claim. We're not liable for indirect, incidental, or consequential damages.
8. Governing law
These Terms are governed by the laws of the State of Utah, United States. Disputes go to the state or federal courts located in Utah County, Utah.

These Terms are a starting point. If your engagement requires a more specific agreement (NDA, work-for-hire, IP assignment), that signed document overrides these Terms for the matters it covers.
